Key points of Apartments/Buildings to be Demolished in Bhubaneswar:

The minister also mentioned that the Bhubaneswar Municipal Corporation (BMC) has registered 1,444 cases against unauthorized constructions, with 451 cases already resolved and 993 cases pending.

ଭୁବନେଶ୍ୱର ଭିତ୍ତିକ ଆବେଦନକାରୀଙ୍କ ପ୍ରତିନିଧିତ୍ୱ ( Bhubaneswar-based petitioner) କରୁଥିବା ଆଡଭୋକେଟ୍ ମୋହିତ ଅଗ୍ରୱାଲ କହିଛନ୍ତି ଯେ ସରକାର ସଂଶୋଧିତ କାର୍ଯ୍ୟକୁ କାର୍ଯ୍ୟକାରୀ କରିବା ପାଇଁ ଆବଶ୍ୟକ ନିୟମ ଗଠନ ନକରିବା ପର୍ଯ୍ୟନ୍ତ ହାଇକୋର୍ଟର ପ୍ରତିବନ୍ଧକ ଜାରି ରହିବ।

ରିଏଲ୍ ଇଷ୍ଟେଟ୍ (ନିୟମାବଳୀ ଏବଂ ବିକାଶ) ଅଧିନିୟମ, 2016 ବିରୁଦ୍ଧରେ ଏହା ଦର୍ଶାଇ 2021 ରେ କରାଯାଇଥିବା ସଂଶୋଧିତ ନିୟମର  ବୈଧତାକୁ (validity ) ଆବେଦନକାରୀ ଚ୍ୟାଲେଞ୍ଜ କରିଥିଲେ।

ଗତ ବର୍ଷ ବିକ୍ରୟ କାର୍ଯ୍ୟ ପଞ୍ଜିକରଣ ( Sale Deeds) ଉପରେ ଏକ ପ୍ରତିବନ୍ଧକ ଲଗାଇ ହାଇକୋର୍ଟ ସରକାରଙ୍କୁ RERA-ଉପଯୁକ୍ତ (compliant) ନିୟମ ଗଠନ କରିବାକୁ ନିର୍ଦ୍ଦେଶ ଦେଇଥିଲେ।

ସୋମବାର ଏହି ମାମଲାର ଶୁଣାଣି ପାଇଁ ଆସିଥିବାବେଳେ ରାଜ୍ୟ ସରକାରଙ୍କ ପରାମର୍ଶଦାତା କୋର୍ଟଙ୍କୁ ସୂଚନା ଦେଇଛନ୍ତି ଯେ ତିନି ମାସ ମଧ୍ୟରେ ଏହି ନିୟମ ଲାଗୁ ହେବ।

ଅବଶ୍ୟ, ନଭେମ୍ବର 2022 ପରଠାରୁ IGR ଓଡିଶା ଦ୍ୱାରା ବିଜ୍ଞପ୍ତି ଅନୁଯାୟୀ ନୂତନ ପରିବର୍ତ୍ତିତ ଫର୍ମାଟରେ (Format) ବିକ୍ରୟ ପାଇଁ ଚୁକ୍ତିନାମାଗୁଡିକର Agreements for Sale) କାର୍ଯ୍ୟକାରିତା ଏବଂ ପଞ୍ଜୀକରଣକୁ ଅନୁମତି ଦେବାରେ କୌଣସି ଆଇନଗତ ପ୍ରତିବନ୍ଧକ ନାହିଁ |

The Orissa High Court on Monday asked the state government to formulate rules for implementing the Apartment Ownership and Management Act within three months.

The court, however, refused to vacate the stay it had imposed in May last year on the registration of sale deeds related to apartments and flats.

“The high court embargo will continue until the government frames the necessary rules to implement the amended act,” said advocate Mohit Agarwal, who was representing a Bhubaneswar-based petitioner.

The petitioner had challenged the validity of an amended rule made in 2021 on the ground that it was contrary to the Real Estate (Regulation and Development) Act, 2016.

Putting a ban on the registration of sale deeds last year, the high court had directed the government to frame RERA-compliant rules.

When the matter came up for hearing on Monday, the state government’s counsel informed the court that the rules would be in place within three months.

However, there is no legal impediment in allowing the execution and registration of agreements for sale strictly in the newly changed format as notified by IGR Odisha since November 2022.

The housing projects where allotments will be made are in Ghatikia, Chandrasekharpur, Gadakana, and Subuddhipur.

The four projects are constructed in public-private partnership (PPP) mode under the ‘Housing for All’ scheme of the state government.

A high-level meeting in this regard was held recently where officials discussed on finalizing the modalities for the smooth allotment of houses to the beneficiaries from the tagged slums.

“As per the decisions taken in the meeting, priority will be given to those People who have made their initial financial contribution for the allotment of houses while others will be given a specific time to pay to get their dwelling units.

All the eligible beneficiaries from the tagged slums will be given an opportunity for allotment of houses on priority in the projects. We are working in close coordination with the civic body to get the list of eligible beneficiaries for the allotment of houses,” BDA vice-chairman” Balwant Singh said.

He said that the objective is to rehabilitate every family from the tagged slums and make the entire slum land available for public infrastructure and other developments. Part rehabilitation of the slums will not serve the purpose of the housing projects, Singh said.”

Sources said an initial amount of Rs1.20 lakh will be collected from EWS (economically weaker sections) category for the allotment of houses and Rs 1 lakh will be taken in installments. For the non-EWS beneficiaries from the slums, the decision is Yet to be taken by the urban development department.

For the smooth execution of various upcoming public infrastructure and development projects where slum households are likely to be affected, it was also suggested in the meeting to construct at least 5,000 transit house facilities at various locations in the city.

Officials said the BDA will put a proposal before the government in this regard for funds to construct the transit houses. Slum dwellers evicted for any sort of development project will be moved to the new transit houses, they said.”

Slum leaders, however, are still reluctant to move into the houses. “We are not going to move into those houses. We want to land in the place from where we are being evicted. We don’t want matchbox-size flats,” the president of All Odisha Basti Surakhya Manch ..Pratap Sahu, said.
